Scope of Application

These terms and conditions of DELUXESIDE LLC (hereinafter "Seller") apply to all contracts that a consumer or entrepreneur (hereinafter "Customer") concludes with the Seller regarding the goods and/or services presented in the Seller's online store. The inclusion of the Customer's own terms and conditions is hereby objected to, unless otherwise agreed.

A consumer within the meaning of these terms is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their independent professional activity. An entrepreneur is any natural or legal person or a partnership with legal capacity that acts in the exercise of their independent professional or commercial activity when concluding a legal transaction.

Conclusion of Contract

The product descriptions contained in the Seller's online store do not constitute binding offers on the part of the Seller, but serve to enable the Customer to submit a binding offer.

The Customer may submit the offer via the online order form integrated in the Seller's online store. After entering their personal data, the Customer submits a legally binding contractual offer by clicking the button that completes the ordering process.

The Seller may accept the Customer's offer within five days by:

  • Sending the Customer a written order confirmation or an order confirmation in text form (fax or email), or
  • Delivering the ordered goods to the Customer, or
  • Requesting the Customer to pay after placing their order.

If several of the above alternatives apply, the contract is concluded at the time when one of the above alternatives first occurs. If the Seller does not accept the Customer's offer within the above period, this is deemed a rejection of the offer, with the result that the Customer is no longer bound by their declaration of intent.

When submitting an offer via the online order form, the contract text is saved by the Seller and sent to the Customer in text form (e.g., email, fax, or letter) after the order has been placed, together with these terms and conditions.

Before placing a binding order, the Customer can continuously correct their entries using the usual keyboard and mouse functions. All entries are displayed once more in a confirmation window before the binding order is placed and can be corrected there as well.

The English language is available for the conclusion of the contract.

Order processing and contact take place via email and automated order processing. The Customer must ensure that the email address provided for order processing is correct so that emails sent by the Seller can be received at this address. In particular, the Customer must ensure that all emails sent by the Seller or by third parties commissioned with order processing can be delivered when using spam filters.

Right of Withdrawal

Consumers generally have a right of withdrawal. Further information on the right of withdrawal can be found in the Seller's cancellation policy.

Prices & Payment Terms

The prices stated by the Seller are total prices. VAT is not shown separately as the Seller falls under the small business regulation. Any additional delivery and shipping costs are stated separately in the respective product description.

For deliveries to countries outside the United States, additional costs may arise in individual cases that the Seller is not responsible for and that are to be borne by the Customer. These include, for example, costs for money transfers by credit institutions (e.g., transfer fees, exchange rate fees) or import duties or taxes (e.g., customs duties).

Various payment options are available to the Customer as indicated in the Seller's online store.

If advance payment is agreed, payment is due immediately after conclusion of the contract.

When selecting a payment method offered via the payment service "Shopify Payments", payment processing is handled by the payment service provider Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland. Delivery & Shipping Terms

Goods are regularly delivered by shipping to the delivery address specified by the Customer. The delivery address specified in the Seller's order processing is decisive for the transaction.

If the transport company returns the shipped goods to the Seller because delivery to the Customer was not possible, the Customer bears the costs for the unsuccessful shipment.

In principle, the risk of accidental loss and accidental deterioration of the goods sold passes upon handover of the goods for shipment or upon delivery to the commissioned transport person.

Self-collection is not possible for logistical reasons.

Warranty

The statutory warranty provisions apply.

Applicable Law & Jurisdiction

If the Customer acts as a consumer, the law of the Customer's country of residence shall apply to all legal relationships of the parties, excluding the UN Convention on the International Sale of Goods. The exclusive place of jurisdiction for all disputes arising from this contract shall be the Customer's place of residence.

If the Customer acts as an entrepreneur, the exclusive place of jurisdiction for all disputes arising from this contract shall be the Seller's place of residence or business.
